Costs Facts 1. The Court of Appeal had decided that Onward had to bear the costs of the appeal proceedings. 2. Exactly one month later the claimant initiated cost proceedings in the Court of Appeal. On the same day it stated that it withdrew the application and filed it in the LD Munich. The JR of the Court of Appeal The withdrawal has to be seen as an application ex R. 265.1 RoP and will be granted. The other side does not need to be heard as they have no interest as they have not even seen the application for costs. Comment The representative was saved by the bell. He should have known that you have to apply for the costs in appeal by initiating cost proceedings at the Division of the First Instance. The question is: did the Registry of the Court of Appeal warn the representative? (In that case, the representative better bring them a good bottle of wine). Everything happened on the same day and thus just in time!

R. 265 VerfO EPG - Berufungsgericht UPC CoA 60/2026 2 SACHVERHALT 1. Mit Anordnung vom 27. März 2026 hat das Berufungsgericht des Einheitlichen Patentgerichts angeordnet, dass die Antragsgegnerin die Kosten des Berufungsverfahrens zu tragen hat. 2. Mit Schriftsatz vom 27. April 2026 hat die Antragstellerin beim Berufungsgericht einen Antrag auf Kostenfestsetzung gemäß R. 151 VerfO eingereicht. Am selben Tag hat die Antragstellerin die Rücknahme dieses Antrags auf Kostenfestsetzung erklärt und mitgeteilt, dass der Kostenfestsetzungsantrag neu bei der Lokalkammer München eingereicht worden sei. GRÜNDE 3. Die Rücknahme des Kostenfestsetzungsantrags vom 27. April 2026 ist analog R. 265 Abs. 1 VerfO zuzulassen, ohne dass es einer Anhörung der Antragsgegnerin bedarf. 4. Der beim Berufungsgericht gestellte Antrag auf Kostenfestsetzung ist der Antragsgegnerin bislang nicht zugegangen. Ein etwaiges Interesse der Antragsgegnerin an einer Sachentscheidung wird durch die Zulassung der Rücknahme nicht beeinträchtigt, da für die Anträge auf Kostenfestsetzung das Gericht erster Instanz zuständig ist (UPC CoA 1/2024, Anordnung v. 29. Juli 2025 – Hanshow/VisionGroup; UPC CoA 845/2024 UPC CoA 603/2025, Anordnung v. 2. Juli 2025 – Philips/Belkin). 5. Eine Kostenentscheidung hinsichtlich des Antrags auf Kostenfestsetzung ist nicht notwendig. In der Regel trägt selbst die erfolgreiche Partei die Kosten des Kostenfestsetzungsverfahrens (UPC CoA 618/2024, Anordnung v. 6. Juni 2025 – Hanshow/Vusion; UPC CoA 845/2024 UPC CoA 603/2025, Anordnung v. 2. Juli 2025 – Philips/Belkin). ANORDNUNG I. Die Rücknahme des Antrags auf Kostenfestsetzung vom 27.
