Synchronisation of dates Facts 1. The Statement of Claim is served with respect to two defendants on 30 December 2025, and with respect to the third defendant on 13 March 2026. 2. On 23 March 2026, the two defendants served on 13 December 2025 request alignment of the data for the defence to 15 June 2026, the date when the Statement of Defence of the third defendant is due. 3. The Claimant agrees. The JR The JR grants the request. Comment 1. It is for all parties involved more practical to have the same dates for all written pleadings for all defendants. 2. When the Rules are revised, it may be good to have a Rule which states that the dates for the written pleadings in case of multiple defendants will be the date of the defendant which is served last. However, if the defendant chooses to file his Statement of Defence earlier, then that earlier date is the starting date for time periods for the written proceedings.

La notifica dello statement of claim si è perfezionata in date differenti per i tre convenuti, ovvero - rispettivamente - in data 30.12.2025 per AGA e ACEF e in data 13.3.2026 per MFCI. La R. 23 RoP prevede un termine di tre mesi decorrente dalla data di avvenuta notifica dello statement of claim per il deposito dello statement of defence e del counterclaim for revocation. In data 23.3.2026 i convenuti AGA e ACEF hanno depositato un’istanza ex R. 9.3(a) RoP con la quale hanno chiesto al Tribunale di estendere in loro favore il termine previsto dalla R. 23 RoP per il deposito dello statement of defence, con eventuale counterclaim for revocation, sino al 15.6.2026, in modo da allinearlo con il termine - allo stato differente - previsto per il convenuto MFCI. I representatives degli attori e di MFCI hanno prestato il proprio assenso espresso a tale richiesta (v. scambio di e-mail allegato all’istanza del 23.3.2026). Ai sensi delle R. 9.3 e 334(a) RoP, the Court may, upon reasoned request of a party, extend or shorten any time limit specified in the Rules of Procedure, even with retroactive effect. Il judge rapporteur rileva che l’accordo tra le parti è ragionevole poiché appare del tutto opportuno allineare la scadenza del termine previsto dalla R. 23 RoP per tutti i convenuti, in modo tale da assicurare una gestione più efficiente del presente procedimento. Alla luce delle considerazioni che precedono, viste le R. 9 e 334 RoP, il judge rapporteur dispone che la scadenza del termine previsto dalla R. 23 RoP è fissata al 15.6.2026 per tutti i convenuti.
